These Terms of Service ("Terms") govern your access to and use of FieldNotes ("the Service"), operated by Unpinned B.V., a private limited company incorporated in the Netherlands ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
FieldNotes is a browser-based qualitative coding platform that uses large language models (LLMs) to assist researchers in coding qualitative data. The AI generates code proposals; all final coding decisions are made by the user. We do not guarantee the accuracy, completeness, or scientific validity of any AI-generated proposal.
Access to the Service is granted by invitation or account creation by an administrator. You are responsible for:

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
You retain ownership of all content you upload to the Service ("Your Data"). You grant us a limited licence to process Your Data solely to provide the Service, including sending excerpt text to LLM providers for proposal generation.
You are solely responsible for:
Code proposals generated by the AI are suggestions only. They may be inaccurate, incomplete, or inappropriate for your research context. You must review every proposal independently. We accept no liability for research outputs, publications, or decisions based on AI-generated proposals. See also our AI Disclaimer.
Subscription pricing is as published on our pricing page. Prices are in EUR and exclude VAT unless otherwise stated. We reserve the right to change pricing with 30 days' notice to existing subscribers. Annual plans are non-refundable after 14 days. Monthly plans may be cancelled at any time; access continues until the end of the billing period.
Free trial accounts and early access accounts are provided at our discretion. We may terminate trial access at any time without notice. Trial data can be exported before termination.
We aim to maintain high availability but do not guarantee uninterrupted access. Planned maintenance will be communicated in advance where possible. We are not liable for losses arising from downtime, data loss, or service interruptions, except where required by mandatory Dutch law.
The Service, including its software, design, and documentation, is owned by Unpinned B.V. and protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service without our written permission. Your Data remains your property.
We may suspend or terminate your account if you breach these Terms, fail to pay subscription fees, or if we discontinue the Service. On termination:

To the maximum extent permitted by Dutch law, Unpinned B.V. is not liable for indirect, incidental, special, or consequential damages arising from your use of the Service, including loss of research data, loss of revenue, or reputational harm. Our total liability for any claim is limited to the subscription fees you paid in the 3 months preceding the claim.
Nothing in these Terms limits liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
These Terms are governed by the laws of the Netherlands. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Utrecht, Netherlands, unless mandatory consumer protection law in your country of residence provides otherwise.
We may update these Terms from time to time. Material changes will be notified by email at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
